Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Fire hazard from crude oil and other hydrocarbon ac- cumulations within dike areas for crude oil storage tanks #106, 16, 15, 27, 35, 26 and 22, resulting from leaking pipes and tanks. Combustibles including paper, wood and insulation materials were also in dike areas of crude oil tanks. Among other methods, one feasible and acceptable abatement method to correct this hazard is to develop and implement an inspection and maintenance program, including but not limited to: (1) The procedures outlined in "API" Guide for Inspection of Refinery Equipment, Publication #2004, Sections 2.4.1 and 2.4.2. (2) Repair and/or replace all broken and leaking pipes and tanks. (3) Remove oil and other hydrocarbons from dike areas. (4) Remove all other combustibles (wooden pallets, planks, trash and etc.) from dike area and initiate a housekeeping program "Or In The Alternative" 29 CFR 1910.38(b)(3): The employer did not control accumulations of flammable and combustible waste materials and residues so that they would not contribute to a fire emergency: (a) Oil, hydrocarbons, wooden pallets, trash and debris was allowed to accumulate inside the asphalt tank dike areas, possibly causing fire and chemicals spills. 29 CFR 1910.106(c)(6): No combustible materials shall be permitted within the tank dike area. (a) Crude oil tanks #15, 16, 22, 26, 27, 35, 106 and 111 had oil and other hydrocarbons, plus combustible material ac- cumulated within the tank dike area.
