Text For Citation: 01 Item/Group: 002 Hazard: LOCKOUT

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Mid-America Millwright Service, Inc. employee(s) were inadequately trained by the employer in that employee(s) were not trained or instructed not to enter the feed mill elevator leg without implementing lockout and/or tagout procedures. On or about June 10, 1996, Mid-America Millwright Service, Inc. employee(s) working at Ox Town Cattle Feeders Inc. were exposed to crushing injuries while performing work on the feed mill elevator leg conveyor belt and pulley in that procedures were not implemented to ensure that working on the belt and pulley was safe from unexpected start up. Among other methods, one feasible and acceptable abatement method to correct this hazard is to provide adequate training to employees on lockout/tagout procedures. IN THE ALTERNATIVE 29 CFR 1910.147(c)(7)(i): The employer did not provide adequate training to ensure that employees acquired the knowledge and skills required for the safe application, usage, and removal of energy control devices: a) Mid-America Millwright Service, Inc. employee(s) were inadequately trained by the employer in that employee(s) were not trained or instructed not to enter the feed mill elevator leg without implementing lockout and/or tagout procedures. On or about June 10, 1996, Mid-America Millwright Service, Inc. employee(s) working at Ox Town Cattle Feeders Inc. were exposed to crushing injuries while performing work on the feed mill elevator leg conveyor belt and pulley in that adequate energy control device(s) were not applied or used to prevent unexpected start up. AND 29 CFR 1910.147(f)(2)(i): When outside servicing personnel were engaged in activities in a facility, the onsite employer and the outside employer did not inform each other of their respective lockout or tagout procedures: a) On or about June 10, 1996, Mid-America Millwright Service, Inc. employee(s) working at Ox Town Cattle Feeders Inc. were exposed to crushing injuries while performing work on the feed mill elevator leg conveyor belt and pulley which required lockout or tagout, and Mid-America Millwright Service Inc. had not informed Ox Town Cattle Feeders Inc. and Freedom Electric, the electrical contractor, of their lockout/tagout procedure(s).IN THE ALTERNATIVE 29 CFR 1928.57(a)(6): The employer did not instruct each employee in the safe operation and servicing of equipment with which he/she is or will be involved: a) Mid-America Millwright Service, Inc. employee(s) were inadequately trained by the employer in that employee(s) were not trained or instructed not to enter the feed mill elevator leg without implementing lockout and/or tagout procedures. On or about June 10, 1996, Mid-America Millwright Service, Inc. employee(s) working at Ox Town Cattle Feeders Inc. were exposed to crushing injuries while performing work on the feed mill elevator leg conveyor belt and pulley in that the energy was not controlled to prevent unexpected start up.
