29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels: Audiometric testing was not provided for the employees with the following exposures: a) Commissary Room, Line 18 - A general laborer was exposed to continuous noise levels in excess of the allowable 8 hour time-weighted average sound level (Action Level). The employees dosimeter dBA level was 111.2% of the permissible level (90 dBA) and was equivalent to approximately 90.8 dBA. The sampling was performed for 435 minutes during one shift on 6/11/15. Zero exposure was assumed for the unsampled period of time. b) Fruit Room, Mezzanine Level - A general laborer was exposed to continuous noise levels in excess of the allowable 8 hour time-weighted average sound level (Action Level). The employees dosimeter dBA level was 86.6% of the permissible level (90 dBA) and was equivalent to approximately 88.9 dBA. The sampling was performed for 332 minutes during one shift on 6/4/15. Zero exposure was assumed for the unsampled period of time. c) Fruit Room, Apple Line - A general laborer was exposed to continuous noise levels in excess of the allowable 8 hour time-weighted average sound level (Action Level). The employees dosimeter dBA level was 74.6% of the permissible level (90 dBA) and was equivalent to approximately 87.9 dBA. The sampling was performed for 460 minutes during one shift on 6/11/15. Zero exposure was assumed for the unsampled period of time. d) Fruit Room, Testing Station - A general laborer was exposed to continuous noise levels in excess of the allowable 8 hour time-weighted average sound level (Action Level). The employees dosimeter dBA level was 69.8% of the permissible level (90 dBA) and was equivalent to approximately 87.4 dBA. The sampling was performed for 467 minutes during one shift on 6/4/15. Zero exposure was assumed for the unsampled period of time. e) Commissary Room, Line 17 - A general laborer was exposed to continuous noise levels in excess of the allowable 8 hour time-weighted average sound level (Action Level). The employees dosimeter dBA level was 68.8% of the permissible level (90 dBA) and was equivalent to approximately 87.3 dBA. The sampling was performed for 464 minutes during one shift on 6/11/15. Zero exposure was assumed for the unsampled period of time. f) Fruit Room, Pineapple Line - A general laborer was exposed to continuous noise levels in excess of the allowable 8 hour time-weighted average sound level (Action Level). The employees dosimeter dBA level was 68.3% of the permissible level (90 dBA) and was equivalent to approximately 87.3 dBA. The sampling was performed for 478 minutes during one shift on 6/11/15. Zero exposure was assumed for the unsampled period of time. g) Commissary Room, Line 14 - A general laborer was exposed to continuous noise levels in excess of the allowable 8 hour time-weighted average sound level (Action Level). The employees dosimeter dBA level was 66.3% of the permissible level (90 dBA) and was equivalent to approximately 87.1 dBA. The sampling was performed for 480 minutes during one shift on 6/11/15. Zero exposure was assumed for the unsampled period of time. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
