Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) On and before June 3, 1988, at the Killian Shopping Center Project, employee(s) were exposed to the hazards of being struck by and buried under falling concrete blocks, when they were permitted to work next to unbraced concrete block wall approximately 20 feet high and 80 feet long. Among other methods one feasible and accepted method to correct this hazard is to temporarily shore or brace the concrete block wall as the work progresses, to prevent collapse due to wind or other forces.
