Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees operated forklifts at the opening beneath the cupola bottom, consisting of coke ash and pocketed molten iron, while punching the bottom with a rod attached to the forks of the lift truck. Employees were exposed to the hazard of being struck by and/or burned by the falling coke ash and pocketed molten iron due to their presence at the opening beneath the cupola bottom: This task was performed each time the cupola bottom failed to fall after opening of the bottom doors and removal of the pins. Among other methods, one feasible and acceptable method to correct this hazard is to comply with American National Standards Institute Z241.2 "Safety Requirements For Melting, pouring of Metals in the Metal Cast Industry" - 1989,6.3.3.3 as follows: 1. In the event the cupola bottom fails to drop, a procedure shall be developed and utilized to facilitate dropping the bottom using methods which maximize personnel safety. 2. The procedure shall prohibit personnel entry into the dropping zone.
