Text For Citation: 01 Item/Group: 002 Hazard:
29 CFR 1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedures and the requirements of this standard were being followed: (a) On or about February 5, 2015, and at certain times before, employees working in the sanitation department were exposed to serious injuries, including amputations, while performing sanitation work in that numerous annual reviews of the energy control procedures failed to ensure that the 29 CFR 1910.147 requirements were being met. The employer had documents evidencing the completion of the required annual LOTO program reviews, but the reviews failed to detect program deficiencies including, but not necessarily limited to, recognizing the installation of a secondary safety interlock system on a meat blender described by the company as "Blender 1, Tunnel 1" and other similarly modified machines. Abatement certification is required for this Item. Use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
