Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries in the event of a forklift tip-over accident because of lack of restraint devices. Among other methods, one feasible and acceptable means of abatement to correct hazard would be to install seatbelts and require the use of such plantwide on all forklifts which contain an overhead guard. 333 CANAL STREET WAREHOUSE: 1.
