Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) On or about 04/29/00 for employees engaged in the replacement of a cleaning light in auditorium #4 of the Carmike Cinema and exposed to a potential fall hazard of approximately 16 feet created by the employer's failure to ensure that proper procedures for the placement and securement of the extension trestle ladder were followed. Among others, feasible and acceptable abatement methods to correct this hazard would be to: (1) Ensure all employees using an extension trestle ladder are positioning and securing the ladder as specified by the manufacturer and ANSI A-14.1-2000; (2) Develop alternative procedures for the replacement of overhead cleaning lights in auditoriums to eliminate the use of an extension trestle ladder; or (3) Relocate cleaning lights to reduce or eliminate fall potential.
