29 CFR 1926.651(h)(1): Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation. The employer does not ensure that adequate precautions are taken to protect employees working in excavations in which there is accumulated water. This violation was observed on or about January 28, 2015, at the jobsite where employees were exposed to cave-in hazards when installing water lines in a trench with an accumulation of water. Pursuant to 29 C.F. R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that adequate precautions are taken to protect employees working in excavations in which there is accumulated water.
