Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The swinging superstructure of the Case 880B backhoe was not barricaded to prevent employees from walking between said swinging superstructure and a concrete wall at the construction site at 4th and Gregory, Champaign, Illinois. Among other methods, one feasible an acceptable abatement method to correct this hazard is to establish a perimeter guard of barricades around all equipment with a swinging superstructure or machinery with a similar movement. These barricades should be of a substantial nature so that employees encountering them will be made aware that they are entering a danger area.
