Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by or caught beneath the raised box of an earth moving type truck while performing inspections, maintenance, repairs, or modifications to the truck while the box was elevated and supported only by the hoist cylinder. a) In the Weld Shop, employees were performing a modification to the WABCO truck dump box by welding an addition to the tail of the box. At the time the box was elevated and supported only by the hoist cylinder. Among other methods, one feasible and useful method to correct the hazard is to provide, and require the use of, a permanently attached, positive means of support which is capable of being locked in position, and which will prevent the accidental lowering of the box while employees are performing inspections, maintenance, repairs, or modifications to the truck.
