29 CFR 1926.20(b)(1): The employer did not initiate and maintain accident prevention programs as necessary to comply with this part: "a) IVO Port of Wilmington - The employer did not initiate or maintain an accident prevention plan that evaluated non-routine operations for hazards. This was observed on December 2, 2014 when Derrick 15 overturned while conducting anchor cable retrieval within the operating area of the cutterhead dredge Essex. The anchor cable fouled the cutterhead during operation, resulting in the derrick conducting the lift overturning and causing the drowning death of one employee."
