29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace. The employer does not ensure that a medical evaluation is completed to determine the employee's ability to wear a respirator prior to the being fit tested or required to wear the respirator in the workplace. A. The violation occurred in the System #1 & #2 Ammonia Refrigeration Engine Rooms on or about November 24, 2014 and at times prior thereto. An employee was exposed to ammonia inhalation hazards when the employer failed to ensure that a medical evaluation was completed for the use of a full and/or half face air-purifying respirator prior to completing fit testing and requiring the employee to use the device(s). Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date the employer must submit documentation showing it is in compliance with the standard, including describing the steps it is taking to ensure that a medical evaluation is completed to determine the employee's ability to wear a respirator prior to the being fit tested or required to wear the respirator in the workplace.
