29 CFR 1910.1027(l)(1)(i)(A): The employer failed to institute a medical surveillance program for all employees who are or may be exposed to cadmium at or above the action level unless the employer demonstrates that the employee is not, and will not be, exposed at or above the action level on 30 or more days per year (twelve consecutive months). On or about November 7, 2023, the employer did not provide a medical surveillance program for employees who are or may be exposed to cadmium at or above the action level on 30 or more days per year. The employer must require employees conducting welding and prep grinding operations to be a part of a surveillance program as they are exposed to respirable hazards including but not limited to Cadmium from the welding operations done by employees including mig welding the anode bolts of the frame of the truck, which are coated in Cadmium, to a catalytic converter cage. During sampling it was determined welders sampled were over the Permissible Exposure Limit (PEL) for Cadmium and a prep grinder was discovered to be over the action level for cadmium.
