29 CFR 1910.217(c)(5)(i): The employer did not use a control system and a brake monitor which complied with paragraphs (b)(13) and (b)(14) of this section on mechanical power presses where the operator fed or removed parts by placing one or both hands in the point of operation, and a two hand control, presence sensing device, Type B gate, or movable barrier guard was used for safeguarding: (a) Cut, Bend, Form - Department 1 - Employees hand fed chair legs into the L&J Press Corp. No. 80 part-revolution mechanical power press, employer machine number P3, which used two-hand controls for point of operation safeguarding, and this mechanical power press did not have a brake monitor, exposing employees to the hazards of getting struck-by or caught-in the point of operation, on or about October 28, 2022. (b) Cut, Bend, Form - Department 1 - Employees hand fed metal parts to make Hudson chair blanks into the part-revolution mechanical power press, employer machine number P2, which used two-hand controls for point of operation safeguarding, and this mechanical power press did not have a brake monitor, exposing employees to the hazards of getting struck-by or caught-in the point of operation, on or about October 28, 2022. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
