29 CFR 1910.146(d)(4)(iv): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not provide personal protective equipment in so far as feasible engineering and work practice controls did not adequately protect employees: (a) On or about April 28, 2022, and at times prior, at or near Milton R. Young Station Minnkota Power Cooperative 3401 24th Street SW, Center, ND, while cleaning out the Plenum, employees were exposed to thermal and inhalation hazards while working with or near Fly Ash, without appropriate personal protective equipment.
