29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when: a) On or about April 23, 2024, the employer did not ensure that a trench box or an alternative protection system was in place prior to an employee entering a 9 foot deep excavation to check grade of the corrugated pipe. As a result, an employee was trapped when a portion of the trench collapsed, pinning an employee.
