29 CFR 1910.217(c)(1)(i): The employer did not provide and ensure the usage of point of operation guards or properly applied point of operation devices on every operation performed on mechanical power presses: (a) Cut, Bend, Form - Department 1 - Employees used a foot pedal to actuate the Swaine full-revolution mechanical power press, employer machine number SP1, to cut a piece from Navy chair legs. Employees hand-fed and removed each part, and the point of operation had no guarding, exposing employees to the hazards of getting hands and fingers struck-by or caught-in the point of operation, on or about October 27, 2022. (b) Cut, Bend, Form - Department 1 - Employees used a foot pedal to actuate the Rousselle full-revolution mechanical stamping press, model 1, serial number S-829, employer machine number SP2, to bend Navy chair legs. Employees hand-fed and removed each part at the left side of the point of operation, and the left side of the point of operation had no guarding. In addition, a 1/2-inch gap existed between the guard at the front of the point of operation and the guard at the right side of the point of operation, permitting access to the point of operation 1 inch away, on or about October 27, 2022. (c) Cut, Bend, Form - Department 1 - Employees used a foot pedal to actuate the Rousselle Stamping Press, model 1A, serial number 700, employer machine number SP7, full-revolution mechanical power press, to punch a chair arm. Employees hand-fed and removed each part, and the point of operation had no guarding, exposing employees to the hazards of getting hands and fingers struck-by or caught-in the point of operation, on or about October 27, 2022. (d) Cut, Bend, Form - Department 1 - Employees used a foot pedal to actuate the mechanical power press, employer machine number SP8 (no manufacturer information seen), to bend parts. Employees hand-fed and removed each part, and the point of operation had no guarding, exposing employees to the hazards of getting hands and fingers struck-by or caught-in the point of operation, on or about October 28, 2022. (e) Cut, Bend, Form - Department 1 - Employees used a foot pedal to actuate the part-revolution mechanical power press, employer machine number P6, to punch holes and to stamp the Emeco name into seat pans. Employees hand-fed and removed each part, and the point of operation had no guarding, exposing employees to the hazards of getting hands and fingers struck-by or caught-in the point of operation, on or about October 28, 2022. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
