29 CFR 1910.146(d)(3)(vi): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not develop and implement the means, procedures, and practices necessary for safe permit entry operations, including, but not limited to, verifying that conditions in the permit space are acceptable for entry throughout the duration of an authorized entry: (a) On or about April 28, 2022, and at times prior, at Milton R. Young Station Minnkota Power Cooperative 3401 24th Street SW, Center, ND, where employees were allowed to enter a confined space, and were exposed to hazards to include fly ash that had accumulated to depths of three to four feet in areas of the Plenum with thermal burn, and known skin irritation and inhalation hazards.
