29 CFR 1926.454(b): The employer did not have each employee involved in erecting, disassembling, moving, operating, repairing, maintaining, or inspecting a scaffold trained by a competent person to recognize any hazards associated with the work in question. a) 38 Long Beach Blvd., Long Beach, NJ: The employees were utilizing scaffold that was not erected and/or inspected by a competent person to recognize the hazards of the scaffold being used. The hazards of the scaffold were lack of fall protection and inadequate working surface, observed on or about 4/20/12. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
