29 CFR 1926.651(k)(2): Where the competent person finds evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees shall be removed from the hazardous area until the necessary precautions have been taken to ensure their safety. a) On or about April 23, 2024, the employer did not ensure that employees were removed from a hazardous area after identifying conditions with a potential for cave-ins. Such as but not limited to, unsupported existing water line, the track side of the excavation was undermined, and no cave in protection was in place. As a result, an employee was trapped in a 9-foot deep trench after the sidewall collapsed.
