29 CFR 1910.95(k)(1): The employer did not train each employee who is exposed to noise at or above an 8-hour time-weighted average of 85 decibels in accordance with the requirements of 29 CFR 1910.95(k): (a) On or about 3/2/2022, for the employees whose exposure to noise may be equal to or exceed an 8-hour time-weighted average of 85 decibels. The employer did not institute a training program and ensure employee participation in the program. Employees were exposed to sound levels of approximately 91.6 and 91.4 dBA respectively. 1KB & MS LLC DBA Kingston Block & Masonry LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.95(k)(1), which was contained in OSHA inspection number 1234830 citation number 1, item number 1d and was affirmed as a final order on 06/14/2019, with respect to a workplace located at 1 Kiefer Lane Kingston, NY 12401.
