29 CFR 1926.28(a): The employer is responsible for requiring the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions or where this part indicates the need for using such equipment to reduce the hazards to the employees. (a) On or about August 30, 2021, the employer did not ensure that each temporary employee was wearing steel toed or metatarsal safety boots when the employees were exposed to to the hazard of a powered industrial truck that brushed against the leg of a sawhorse that was supporting a 500 pound steel beam, causing the beam to fall and land on the foot of a temporary employee.
