29 CFR 1926.602(b)(3): The safety requirements, ratios, or limitations applicable to machines or attachment usage covered in Power Crane and Shovel Associations Standards No. 1 and No. 2 of 1968, and No. 3 of 1969, were not complied with: a) At the work site and on September 6, 2012, the employer failed to comply with Standard No. 3, Mobile Hydraulic Excavator Standards, Section 8.01 in that employees were were generally familiar with excavator operation but were not required to thoroughly study and understand all the instructions contained within the owner's manual prior to operating the John Deere 690E LC Excavator.
