29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. a) 38 Long Beach Blvd., Long Beach, NJ: The employees were utilizing scaffold at a height greater than 12 feet from the ground level and were not trained on the use of scaffold by a qualified person to recognize the hazards of unprotected scaffold, observed on or about 4/20/12. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
