Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling down the elevator shaft or being crushed by a moving elevator: a)Job Site 1st through 5th Floors: The elevator hoistway doors were not installed on all hoistway entrances exposing the employees to a fall hazard or being crushed by a moving elevator, on or about 07/12/05. Among other methods, one feasible means of abatement to correct this hazard is to follow guidelines outlined in the Safety Code For Existing Elevators And Escalators, ASME A17.3- 1996, Section 2.6.1 "Doors or Gates Required" which states in Section 2.6.1 (a) "Passenger Elevators. Hoistway-landing openings for passenger elevators shall be provided with entrances which guard the full width and the height of the openings." NOTE: Because abatement of this violation is already documented in the inspection case file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.
