29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions had been taken to ensure their safety: (a) Quick's Hoe & Landscape Service, Inc., @ 6784 Oneida St., Commerce City, CO 80022: On 1/26/12, the competent person did not remove employees from hazards related to working inside an unprotected excavation. Employees conducted fire hydrant extension and replacement for three hours in an excavation which measured approximately 6 feet deep without the aid of a cave-in protection system. This condition exposed employees to struck-by hazards.
