29 CFR 1926.201(a): 29 CFR 1926.201(a)(1): The use of flaggers, signaling by flaggers or the warning garments worn by flaggers did not conform to Part IV of the manual on Uniform Traffic Control Devices ("MUTCD"), 1988 Edition, Revision 3, September 3 or Part VI of the Manual on Uniform Traffic Control Devices, Millennium Edition, December 2000, FHWA, which are incorporated by reference. a) On or about February 4, 2025, at a worksite located at 1776 K Street NW, Washington DC; the employer had an employee operating a MEC Micro 26 AC scissor lift across 6 lanes of traffic in a pedestrian lane without flaggers to help maintain the operational area around the equipment clear from pedestrians while traveling along the cross-walk while traveling. The lack of the flagger placed the operator in front of the equipment while traveling and exposing him to a struck by hazard. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. This documentation may include but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
