29 CFR 1926.1413(a)(4)(i): When a deficiency in Category I (see paragraph (a)(2)(i) of this section) was identified, an immediate determination was not made by the competent person as to whether the deficiency constituted a safety hazard. If the deficiency is determined to constitute a safety hazard, operations involving use of the wire rope in question must be prohibited. a) Jobsite: On or about 6/20/24, the employer did not ensure that a competent person made an immediate determination to remove the crane from service until the wire rope safety hazards, including burned and improperly applied end connections, rust and corrosion, little to no lubrication, and fraying end connections, were corrected.
