29 CFR 1910.29(b)(13)(i): Has a self-closing gate that slides or swings away from the hole, and is equipped with a top rail and midrail or equivalent intermediate member that meets the requirements in paragraph (b) of this section; or [Is offset to prevent an employee from walking or falling into the hole] At an establishment located at 1740 Eisenhower Road in De Pere, Wisconsin, employees of Robinson, Inc. were not provided self-closing gates to protect employees on the production floor from fall hazards up to 14 feet in areas such as but not limited to: a) On or about December 11, 2023, the employer did not protect employees from fall hazards on the elevated work platform above the CO2 laser (L2) and were exposed to fall hazards of approximately 9 feet. b) On or about December 6, 2023, the employer did not protect employees from fall hazards on the elevated work platform above the tube bender and were exposed to fall hazards of approximately 10 and a half feet. c) On or about December 11, 2023, the employer did not protect employees from fall hazards on the elevated work platform above fiber laser (LA-07) and were exposed to fall hazards of approximately 8 feet 5 inches. d) On or about December 11, 2023, the employer did not protect employees from fall hazards on the elevated work platform above the Bridgeport and were exposed to fall hazards of approximately 14 feet. e) On or about December 11, 2023, the employer did not protect employees from fall hazards on the elevated work platform above the fiber laser (LA-08) and were exposed to fall hazards of approximately 8 feet 5 inches. f) On or about December 11, 2023, the employer did not protect employees from fall hazards on the elevated work platform above the fiber laser (LA-06) and were exposed to fall hazards of approximately 8 feet 5 inches.
