29 CFR 1910.178(a): Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. a) On or about 10/06/2023, employer did not ensure a Yale Lift Truck (SN:C801N03386A), with an unsecured pallet added to the forks that employees were standing on to load inventory including 50-pound bags of rocks salt at elevations of 12'8", had received written approval from the manufacturer for the modification that affected capacity and safe operation.
