29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): On or about January 10, 2023, employees required to operate the following powered industrial trucks exposed employees in the area to crushed-by hazards in that they were not competent to do so: (a) A Hyundai, Model: 25G-7A, a compressed gas powered industrial truck. (b) A BYD, Model: ECB18S-B, electric powered industrial truck.
