29 CFR 1910.178(q)(6): Industrial trucks shall not be altered so that the relative positions of the various parts are different from what they were when originally received from the manufacturer, nor shall they be altered either by the addition of extra parts not provided by the manufacturer or by the elimination of any parts. Additional counterweighting of fork trucks shall not be done unless approved by the truck manufacturer. a. Shop and Laydown Areas: On or about June 3, 2022, and times prior, the employer exposed employees to struck-by hazards, in that the employer used counterweights on a "Clark" forklift (P445L-0145-9887KP) where the weights were not approved by the forklift manufacturer and the forklift was used by employees to move heavy equipment.
