29 CFR 1926.451(g)(4)(xv): The employer did not install crossbracing to be acceptable in place of a midrail when the crossing point of two braces is between 20 inches (0.5 m) and 30 inches (0.8 m) above the work platform or as a toprail when the crossing point of two braces is between 38 inches (0.97 m) and 48 inches (1.3 m) above the work platform. The end points at each upright shall be no more than 48 inches (1.3 m) apart: a) On or before November 17, 2021, and at times prior, the controlling employer, Murray & Stafford, Inc., did not ensure that subcontracted employees were protected by guardrail systems while working on a supported scaffold of approximately 30 feet high. Cross braces were used as guardrail systems on the scaffold without a mid rail installed. The height of the cross brace crossing points were 48 inches high. This condition exposed employees to fall hazards of more than 10 feet.
