29 CFR 1910.134(f)(2): Employee(s) using tight-fitting facepiece respirators were not fit tested prior to initial use of the respirator or annually refitted: a) At the facility, The Residence of Lakeridge dba Spring Oak of Toms River, LLC located at 2145 Whitesville Road in Toms River, NJ: On or about 1/10/2021 and thereafter, the employer did not provide a fit test to all employees required to wear respirators. The employer required employees, including CMAs, CNAs and LPNs, to wear N95 filtering facepiece respirators to protect against the SARS-CoV-2 virus while providing care to suspected and confirmed COVID-19 positive residents. NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.
