29 CFR 1910.134(k)(1): The employer did not provide effective training that covered the required elements in 1910.134(k)(1)(i) -(vii): a) Heritage Operating Associates, LLC dba The Grand Rehabilitation and Nursing at Utica located at 1657 Sunset Ave., Utica, NY 13502, on or about January 23, 2021 and thereafter: employer did not provide effective training to include but not limited to: the effects of improper fit; limitations; maintenance and care; medical signs and symptoms preventing effective use and seal check of filtering facepiece respirators. The employer required employees to wear N95 filtering facepiece respirators to protect against the SARS-CoV-2 virus while providing direct care to suspected and confirmed positive COVID-19 residents.
