29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) At the facility, 205 East 1st Street, Corning, N.Y. : The employer provided and required employees to wear N-95 respirators. The employees provide direct care to COVID-19 positive and / or suspected residents. The employees were not provided with medical evaluations to determine the employees' ability to use a respirator, before the employees were fit-tested or required to use the respirator in the workplace. The Violation occurred on or about, 01/07/2021 through 01/21/2021. b) At the facility, 205 East 1st Street, Corning, N.Y.: The employer provided and required employees to wear KN95 respirators. The employees provide direct care to COVID-19 positive or suspected residents. The employees were not provided with medical evaluations to determine the employees' ability to use a respirator, before the employees were fit-tested or required to use a respirator in the workplace. The violation occurred on or about 12/20/2020 through 01/07/2021. Abatement documentation must be submitted for this item
