29 CFR 1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: Kitty Hawk, NC: On or about October 14, 2020, the employer did not ensure employees potentially subjected to respiratory distress by using 3M half-half elastomeric respirators while engaging in minor recreational water vehicle patching and touch up maintenance work were medically evaluated prior to donning such equipment.
