29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) At the facility, 1621 Route 22 West Operating Company, LLC, Bound Brook, NJ. The employer did not provide a medical evaluation to determine each employee�s ability to use a respirator before requiring the use. The employer provided and required employees including, but not limited to, Registered Nurses, Licensed Practical Nurses, Certified Nursing Assistants, and Housekeeping staff to wear N95 respirators and respirators labeled as KN95 at the facility. These employees provided direct care and services to suspected and confirmed positive COVID-19 patients. Violation occurred on or about 5/09/20, and thereafter.
