29 CFR 1910.134(f)(2): The employer shall ensure that an employee using a tight-fitting face piece respirator is fit tested prior to initial use of the respirator, whenever a different respirator face piece (size, style, model or make) is used, and at least annually thereafter: Heritage Care Center of Berkeley located at 4401 North Hanley Road, Berkeley, MO 63134: On or about August 10, 2020, the employer did not provide a fit test to all employees required to wear N95 filtering facepiece respirators throughout their shifts to protect against the SARS-CoV-2 virus while providing care to suspected and confirmed positive COVID-19 residents.
