29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a. On or about April 23, 2020 and thereafter, at the Long Term Care 4th and 5th floors. The employer did not provide medical evaluations for employees such as Registered Nurses (RNs), Licensed Practical Nurses (LPNs), and Certified Nursing Assistants (CNAs) who were required to wear tight-fitting N95 and KN95 respirators while providing care to confirmed and suspected COVID-19 positive patients. NOTE: Certification of abatement is not required for this citation item as abatement was documented by the compliance safety and health officer during the inspection.
