29 CFR 1910.134(e)(1) : The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) Throughout the facility, Innova Gloucester Deptford Bridge Operations LLC in Deptford, NJ - The employer provided N95 respirators and respirators labeled as KN95 at the facility. The employer did not ensure that RNs, LPNs, CNAs and housekeeping staff were provided with a medical evaluation prior to their use of the respirators, on or about 4/19/2020 and after. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
