29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems are not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. Inspections are not conducted by the competent person prior to the start of work and as needed throughout the shift. (a) On February 28, 2020; the employer did not ensure that the competent person inspected the excavation throughout the shift, exposing employees to engulfment hazards. Employees worked in an excavation approximately 6.3' deep with near vertical walls and Type C soil without cave-in protection. Fissuring was present in the east wall under the signal boxes. Note: Abatement certification and documentation are required for this item.
