29 CFR 1915.12(c)(1)(ii): The employer did not ensure that spaces or adjacent spaces that contain or have contained liquids, gases, or solids that were toxic, corrosive or irritant were tested by a competent person to determine the air concentration of toxics, corrosives, or irritants within the space prior to initial entry by an employee. (a) Boat Barn - Fishing Vessel (FV) Progress - On or about February 1st, 2019 and at times prior thereto, employees were exposed to potential toxic atmospheres while accessing confined and enclosed spaces including, but not limited to: Fuel Oil Tanks #1 port/starboard, #2 port/starboard, #3 port/starboard, #4 port/starboard and Fish Hold #1-4 without a gas free competent person performing safe for entry inspections and testing for toxics. Employees were stick welding and cutting with oxygen and acetylene torches which can create a toxic atmosphere.
