29 CFR 1910.1200(e)(1): Employers did not develop, implement, and maintain at each workplace, a written hazard communication program which described how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training was met. a) On or about August 11th, 2018 or prior thereto: Entry was conducted into a 8000 gallon 1988 Beat Tanker DOT classified 306 trailer to weld a baffle. The employer did not have a hazard communication program that corresponded to hazardous chemicals in the welding process, such as the flux core, steel tank and petroleum products. b) On or about August 14th, 2018 or prior thereto: Mig welding was conducted on a 8000 gallon 1988 Beat Tanker DOT classified 306 trailer to repair a vapor rail. The employer did not have a hazard communication program that corresponded to hazardous chemicals in the welding process such as the flux core, steel tank and petroleum products.
