29 CFR 1926.1101(f)(2)(ii): The employer failed to presume that employees were exposed in excess of the Time Weighted Average (TWA) and excursion limit during Class I asbestos work, prior to a negative exposure assessment made pursuant to 29 CFR 1926.1101(f)(2)(iii) or exposure monitoring was conducted: a) Advanced Construction and Design Services, LLC: On or about April 11-12, 2018, at the jobsite located at 1650 W. Irving Park Rd. Chicago, Illinois, the employer did not presume that employees were exposed in excess of the Time Weighted Average (TWA) and excursion limit when a negative exposure assessment had not been conducted prior to Class I asbestos work being performed, including the disturbance and removal of the thermal system insulation containing 18-35% chrysotile asbestos, during demolition operations.
