29 CFR 1926.651(k)(2): Where the competent person finds evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees shall be removed from the hazardous area until the necessary precautions have been taken to ensure their safety: a)Olson Digging Service at 3708 East Brewster Street, Sioux Falls, SD 57106: On or about May 3, 2018, the competent person did not remove an employees from a hazardous area after identifying conditions related to cave-in within a trench excavation. On May 3, 2018, two employees accessed a seven-foot deep trench which was lacking an adequate protective system and where water had accumulated. An employee was fatally injured after the south wall of the excavation sloughed and trapped the employee. This condition exposed employees to cave-in and crushing hazards.
