29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible excavation cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: (a) Banuelos Quality Concrete Corp. at 3137 W. Denver Place, Denver, CO 80211: On and before August 7, 2017, the employer did not ensure daily inspections of the excavation were made by a "competent person" for evidence of a situation that could have resulted in excavated material falling and/or rolling into the excavation. The excavated soil (spoil pile) was placed along the back (west) edge of the 10 foot deep excavation. Condition exposed employees working in the excavation to struck-by hazards associated with material falling and/or rolling into the excavation.
