29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions. (a) On or about August 15, 2016, and at times prior thereto, employees exposed to hazardous conditions were not required to don appropriate personal protective equipment, such as but not limited to protective helmets when exposed to overhead hazards and/or use safety glasses while using pneumatic nail guns while performing framing activities. Note: Abatement certification IS required for this item.
