Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck due to uncontrolled movement of unit and falling from height of 39 feet: a)Site 65 East 55th Street: Employer did not maintain records of employees training for each type of Elevating Aerial platforms as required in ANSI 92.3 1990 section 7.6.2 and records of the frequent and annual inspection performed by owner as required in ANSI 92.3 section 6.12.3 on or about 12/02/96. Abatement Note: Among other method, one feasible and accepted method to correct this hazard is to use the Genie as instructed by manufacture and train the employees as required in ANSI A 92.3 1990 Section 8.6., conduct inspection and retain written records as in ANSI 92.3 section 6.12.3 and 7.6.2.
